Building on vacant land: what changes when there’s no build contract yet

Vacant land is treated differently to a house & land package or an existing home, and it’s treated differently again depending on whether construction is imminent. Location, land size, LVR and whether you have a build contract already in hand can all change which lenders are willing to accept it as security at all.

Why “just land” isn’t one product

Some lenders accept standalone vacant land as security; some reduce the maximum LVR for land compared with an established home; some require construction to begin within a defined period after settlement; and some won’t accept vacant land as sole security at all. Metro, regional and rural land can also be treated differently by the same lender.

Questions worth answering before you commit to land

  • Do you already have a build contract, or are you buying land first and planning to build later?
  • When do you realistically expect construction to start?
  • Is the land metro, regional or rural, and what size is the block?
  • Does the land have full services and normal access, or does it need special zoning consideration?
  • Is this your first home, and does the state’s vacant-land duty/grant treatment differ from an established-home purchase?

Government treatment differs too

Vacant-land duty thresholds and any first-home concession are commonly set separately from the established-home rules in each state, a lower purchase price doesn’t automatically mean a proportionally lower duty concession. Run your specific state and land value through the Funds Position calculator rather than assuming the established-home figures apply.

What to prepare

  • Land contract and title details, including size, zoning and access
  • A realistic timeline for when you intend to build
  • Any build contract you already have, even in draft form
